Terms of Service for PolicyGuardian

These Terms of Service (“Terms”) govern your access to and use of the PolicyGuardian Chrome extension, web dashboard, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Services Provided

PolicyGuardian provides tools for independent insurance professionals to monitor policy status changes (such as cancellations, renewals, and non-renewals) across supported carrier portals. The Services include a Chrome extension, backend infrastructure, and a web-based dashboard.

2. Eligibility and Accounts

  • You must be at least 18 years old to use the Services.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate and complete information during registration and to keep your account information up to date.

3. User Responsibilities

  • You may use the Services only for lawful business purposes related to managing insurance policies.
  • You are solely responsible for compliance with your carrier agreements and any applicable laws or regulations.
  • You agree not to misuse the Services, including attempting to gain unauthorized access, reverse engineer, or interfere with the Services or related systems.

4. License and Restrictions

PolicyGuardian grants you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. You may not:

  • Copy, modify, or distribute the Services.
  • Sell, sublicense, or otherwise make the Services available to third parties except as expressly permitted.
  • Circumvent or disable security features of the Services.

5. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your data. By using the Services, you consent to our data practices as outlined in the Privacy Policy.

6. Subscription and Payment

  • Access to the Services is provided on a subscription basis according to the pricing tiers published at policyguardian.ai.
  • Subscriptions are billed in advance on a monthly basis through our payment processor.
  • Fees are non-refundable except where required by law.
  • We may change pricing upon notice; continued use of the Services after changes constitutes acceptance of the new pricing.

7. Service Availability and Changes

  • We aim to provide reliable and continuous access to the Services but do not guarantee uninterrupted or error-free operation.
  • Carrier portal changes may affect functionality, and we reserve the right to update or discontinue integrations as needed.
  • We may modify or discontinue any aspect of the Services at any time, with or without notice.

8. Termination

  • We may suspend or terminate your access to the Services if you fail to comply with these Terms, fail to pay fees when due, or misuse the Services.
  • You may cancel your subscription at any time through your account settings. Termination does not relieve you of any payment obligations incurred before the effective termination date.

9. Intellectual Property

All rights, title, and interest in the Services, including software, logos, and branding, remain the exclusive property of PolicyGuardian. No rights are granted except those expressly set forth in these Terms.

10. Disclaimers

  • The Services are provided “as is” and “as available.”
  • PolicyGuardian disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.
  • We do not guarantee prevention of all missed cancellations or revenue loss.

11. Limitation of Liability

To the maximum extent permitted by law, PolicyGuardian’s total liability for any claim arising out of or relating to the Services is limited to the amount you paid to PolicyGuardian in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes will be resolved through binding arbitration in Dallas, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated by posting the updated Terms on our website or via extension notices. Your continued use of the Services constitutes acceptance of the revised Terms.
